This Privacy Policy describes how SendingCell, LLC (“SendingCell,” “we”, or “us”) collect, use, and share your personal information and the choices you may have regarding our use of your personal information. We may update and make changes to this policy, so we encourage you to review it periodically.

This policy applies to all visitors to this website and all SendingCell websites and services, including any apps, websites, features, and other services. Please remember that your use of this website is also subject to our Terms and Conditions.

  • If you use our Virtuoso platform, when you create or update your account

  • To comply with our legal and regulatory obligations

 

We may use the information we collect from you to provide you additional information on goods or services that you have requested. This may include calls at the number you have provided or additional marketing communications by email.

5. How We Share your Information with Third Parties.

We may share your information with third parties:

  • to respond to requests from you or to provide services you have requested

  • in response to a legal obligation or as reasonably necessary to comply with the law, respond to a legal process, exercise legal claims, enforce this policy or any contract we have with you, or protect against harm to the interests of SendingCell or others.

  • to obtain professional advice, including from our lawyers and accountants

  • in connection with a restructuring, merger, or sale of assets and any related negotiations

SendingCell does not sell or share your personal information as those terms are defined in the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA).

6. Use or Disclosure of Sensitive Personal Information.

SendingCell does not generally collect or require sensitive personal information, and we ask that you avoid sending any such information in your communications with us. To the extent we collect sensitive personal information, we will only use or disclose it either with your specific consent when required, or as otherwise permitted by law. As we do not use or disclose sensitive personal information for other purposes without your consent, we do not offer you an option to limit the use of sensitive personal information other than through the settings and controls available to you through your third-party account providers or your browser or mobile device operating system.

SendingCell employs a range of administrative, organizational, technical, and physical safeguards designed to help protect your data against unauthorized access, use, disclosure, loss, or modification. We endeavor to use reasonably available state-of-the-art network and information security standards, protocols and technologies, including encryption, intrusion detection and data loss prevention, and we monitor our systems to ensure that they comply with our security policies.

8. How Long Your Personal Information Will Be Kept.

We will keep your personal information while we are providing products and/or services to you or while you have an account with us. Thereafter, we will keep your personal information for as long as is necessary:

  • To provide the services to you

  • To respond to any questions, complaints or claims made by you or on your behalf;

  • To keep records required by law or to defend ourselves against legal claims.

 

We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information. When it is no longer necessary to retain your personal information, we will delete or anonymize it.

You have the following rights as a California consumer:

  • Right to correct inaccurate personal information that we maintain about you. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

  • Right to limit the use or disclosure of your sensitive personal information for reasons other than those set forth in 6. Use or Disclosure of Sensitive Personal Information.

  • Right not to receive discriminatory treatment for exercising any of these rights.

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services that you do not want them to track your online activities. We do not honor “Do Not Track” signals.

10. How to Exercise Your Rights.

You can submit a request to exercise your rights to access, correct, or delete your personal information by sending an email to [email address] and providing us with your [name, address, phone number, email] or using one of the following methods by contacting us at [phone number]. Please note that you may only make a data disclosure request twice within a 12-month period.

Some states allow you to appeal a denial of your request to exercise the privacy rights provided by the state law. If you are a resident of Colorado, Connecticut, Oregon, Texas, or Virginia and we deny your request, you can appeal the denial of a request to exercise privacy rights by following the instructions listed in the denial communication.

11. Verification of Your Identify

We will need your contact information, including your name, address, phone number, and email, to verify your identity for access, correction, or deletion requests. Our verification process may also include asking you to answer a few questions about yourself to help us verify your identity. We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person's behalf. Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

12. Authorized Agent Request

If you are an authorized agent, then you will be required to submit your contact information as well as provide information about the consumer for whom you are making a request. We may request additional information to verify you or your agent's identity (for example, by requesting an ID or any other reasonable proof of identity) and the validity of the request. If you or your agent do not or cannot provide the required verification information, we reserve the right to refuse granting your request.

We may update this policy from time to time as the Website changes and privacy law evolves. If we update it, we will do so online. When you use the Website, you are agreeing to the most recent terms of this policy.
